Q: How to protect the intellectual property in the opening ceremony of the Olympic Games? For example the 2008 Beijing Olympic opening show. A: I think it’s very clear that the opening show was a copyright protected issue. So that means when other television broadcasters would like to broadcast the show they would need permission of Beijing Olympic organizing committee and one of the best ways to secure that broadcasters should do is to make it clear that the Olympic organizing committee has this copyright. So they should make it clear that who is good enough to have this permission I think most of the countries don’t have to make a registration and there is not necessary to make a registration to the copyright. In many European countries, you don’t have to do anything in order to have that copyright. To protect the show, if the organizing committee finds out that somebody has used the show without permission, then you have the possibility to ask them for a damages and ask them to stop and if not and go to the court because you can not do it before. When they broadcast the show you can not protect the show through the technical means. If they put out them on DVD, you can have some technical protect measures.
Q: But it is also difficult to know who are infringe my copyright and when. A: Yes. That is a grown problem for many broadcasters. There are lots of piracies in the sport programs of television. One of the issues is how to find out that somebody else has distributed you concept. More and more we would see that broadcasters use the same philosophy, especially the music copyright owners the go together and anti piracy groups and so on which can search the internet so we can find out them.
Q: How do you feel about the level of copyright protection in China? A: I don’t know much about the legislation but I know there is too much piracy. There is a lot of physical piracy which is a big problem in China but also in our countries because the piracy in China is exported to our countries. The CDs and DVDs are exported to our countries.
Q: How to deal with the on-line piracy in your country? A: It’s a big problem. One of the things that we go to do is the anti-piracy school. We are doing a lot of things. As soon as we find out on the website with some music, films, computer games without any authorized, we will ask them to stop and if not we will go to the court. We also have court cases against the website given the file sharing. We have savants of the markets and try to find out who sell it, so we can go to the police.
Q: How do you think about the UGC website problem? A: That’s a big problem. One possibility is to try to make a court case against the owners of website. And I think many cases can be proved successful because the owners of the website could find the court cases and they can know the damages they will pay so they will stop. In some cases, if some UGC website owners have been put into prison and somebody else will not continue it. So I think one of the possibilities is to order ISP whose who own the website to block illegal website. But that’s not easy. I think the answer to this problem is the cooperation between right owners and ISP.
Q: Can share some advanced method to protect copyright in your own country? A: Making it easy to legal sales or legal distribution of films and games is important both on physical and online. For instance, on the internet there are too many illegal file sharing and hyper links to place the music and films. It’s very difficult to establish these few special models with the legal sales because people can get them for free. There is a competition between the illegal sites which for free and those who want to make business model which you must pay include the custom pay. I think the government shall make free work to make it is easier to have these online store.
